Please read this document carefully as it contains the terms and conditions of sale and/or rental that you agree to comply with when using the “Bora Bora Camper & Co” online store (hereinafter “Borabora”). The terms and conditions indicated below (the "Conditions") will apply to the use you make of the Borabora Online Store and to all purchases you make through it. Criteria for placing orders:
You may only purchase products: that are available for sale or rent and whose details appear in Bora Bora; with delivery in Spain; and intended for personal use, either your own or that of the recipients for whom you purchase or rent the products. Bora Bora reserves the right to refuse any order at its sole discretion (for example, where it believes that the order in question is intended to be subsequently sold or rented through means other than Bora Bora's authorized distribution channels).
The details of the products available for purchase (including their corresponding price) are specified in Bora Bora. Bora Bora will take all necessary and reasonable steps to ensure that all product details, descriptions and prices on its website are correct. While we will try our best to keep the Bora Bora store as up-to-date as possible, the information specified at any given time may not always reflect the exact situation when you place an order.
Execution of Product Purchase Orders and Conclusion of the Purchase Agreement:
Once you have selected the products you wish to purchase, these products will be included in the shopping cart. At the end of the verification process, you will click on the “order summary” button to access the order summary page where you can identify and correct possible information errors. At the bottom of the order summary page, you will need to click the 'order submission' button for us to receive a binding order.
Once you have clicked on the "submit order" button, we will obtain an authorization from your credit or debit card bank for the amount indicated on the order summary page. At this point in the process, we will not deduct funds from your card, although the available balance on your card will be reduced upon authorization. This process is the usual procedure followed by banks. If your credit card is not authorized, the order will not be processed. Bora Bora will send you an e-mail confirming receipt of your product order, which does not constitute automatic acceptance by us of your order. Bora Bora will send you a second e-mail accepting your product order and confirming that the products you have ordered will be shipped (“Shipping Confirmation”). You and Bora Bora will have entered into a contract for the sale or rental of the products requested by you once we have sent you the Shipping Confirmation e-mail and in any case, when you receive the aforementioned products.
The contract of sale will be held in Spanish. The text of the purchase or rental contract will be included in the Shipping Confirmation e-mail and will be stored by Golden. Bora Bora may, at its sole discretion, refuse to process the order, or not proceed with said processing, in the following cases, without limitation:
- When the product requested by you has ceased to be manufactured or is not available for rental;
- When the bank of your credit or debit card does not authorize the payment of the purchase;
- When you do not meet the criteria, for placing orders, specified at the beginning of this section.
In this case, Bora Bora will notify the consumer of what happened, and will proceed, where appropriate, to return the entire purchase immediately. Once the purchase or rental has been made and at the time the shipment is made, Bora Bora will send the User the corresponding invoice to the indicated billing address. The order confirmation will not be valid as an invoice, only as proof of purchase.
The order will be delivered to the place indicated by the User in the form, or will be picked up at the place indicated by Bora Bora (according to prior agreement) and in the selected time slot. Previously, the Portal will analyze if there is delivery availability in the indicated postal code and will only propose the available delivery slots. Deliveries will be made from Monday to Saturday, except holidays (national, local or regional). The Company will not assume any responsibility for delays in the delivery of orders or for undelivered products when due to cases of force majeure, understood as non-culpable events that are impossible to foresee or that, being foreseeable, were unavoidable.
You can pay by bank transfer or bank card. The charge on your bank card will be made at the conclusion of the sales contract. Payment by credit card is completely secure. The entire transaction is encrypted through a bank validation server using the SSL (Secure Socket Layer) encryption protocol, so your credit card number and expiration date are instantly encrypted in your computer before being sent by the SSL protocol. No one will be able to use your data without your authorization, since the information is unreadable. For greater security, this data is not stored on our server, so you must provide us with all the information with each new order. Borabora reserves the right to request any user to justify the payment of their order and/or to identify themselves by electronically submitting a personal document that proves their identity and address.
RIGHT OF WITHDRAWAL
Return and Cancellation of the Order
The user has fourteen (14) calendar days to cancel the purchase or rental. This period begins from the confirmation of payment. Within this period, you can cancel your purchase or rental (the expenses generated by the management and transport of the selected vehicles will be borne by you) together with the purchase receipt or invoice. Withdrawal does not require an indication of the reason. This right of withdrawal will not apply to products made according to specifications given by you, that is, clearly personalized, nor to items that have been used. To exercise the right of withdrawal, you must notify us of your name, your full address and, if you have them, your telephone number and your email address, your decision to withdraw from the contract through an unequivocal statement by email to “email@example.com”.
Consequences of withdrawal:
In case of withdrawal by you, we will return all payments received from you, excluding delivery costs, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from the this contract. We will proceed to make said reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise. We may withhold reimbursement until we have received the goods, or until you have provided proof of return of the goods, depending on which condition is met first. Without undue delay and, in any case, no later than 14 calendar days from the date on which you notify us of your decision to withdraw from the contract, you must deliver or send the merchandise to the address indicated below. The deadline will be considered met if you return the goods before the deadline has expired. You must bear the direct cost of returning the goods and you will only be responsible for the decrease in value of the goods resulting from handling other than that necessary to establish the characteristics of the goods.

The refund of your money will be made by the same payment method that you used when placing your order. The estimated time for your refund is 3 to 5 business days (keep in mind that depending on your bank this period may be longer) since we have received the products of your return.
Bora Bora reserves the right to: modify or cancel, temporarily or permanently, the service provided through Bora Bora (or any part thereof) with or without notice. Bora Bora will not be liable to you or any third party for any such modification or cancellation; and/or if, despite the modification of the Terms and Conditions and/or the Delivery Conditions, you continue to use the service provided through Bora Bora (or any part thereof) after such modification, you will be deemed to have given your agreement. to said change. You are responsible for checking the Terms regularly to determine if any changes have occurred. If you do not agree to any changes to the Terms and Conditions, you must immediately stop using the Bora Bora service. Should Bora Bora amend these Terms, your order will be subject to the Terms in effect on the date and time you placed your order. In the event that any part of the Terms and Conditions is declared illegal or inapplicable, the affected provision will be considered eliminated, the remaining provisions of the aforementioned Terms and Conditions remaining fully in force. The purchase or rental contract entered into between you and our company will be governed by Spanish law. Any conflict related to the Terms and Conditions must be resolved in the courts of the place where your domicile is located.
